Applying the principles laid down by the Court of Arches in Re Blagdon Cemetery [2002] Fam 299,6 Ecc LJ 420, the chancellor refused a faculty for the exhumation of the cremated remains of the petitioner's wife, stating that the absence of unanimity among the deceased's nearest relatives, namely her husband and her son, was a powerful, if not overwhelming, factor which militated against the granting of a faculty.
